By accessing or using our website and services (collectively, the "Platform"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree, please do not use the Platform. These Terms apply to all users in Canada and the United States.
1. Acceptance of Terms
By creating an account, browsing the Platform, or submitting any content, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy, which is incorporated by reference. If you are accessing the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Eligibility & Children's Privacy (COPPA/PIPEDA)
You must be at least 13 years of age to use the Platform. In compliance with the Children's Online Privacy Protection Act (COPPA) and Canada's PIPEDA, we do not knowingly collect personal information from children under 13. If we become aware that a user is under 13, we will promptly delete their account and associated data. If you are between 13 and the age of majority in your jurisdiction, you must have the consent of a parent or legal guardian to use the Platform.
3. User Accounts
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration and keep it updated.
- Keep your login credentials confidential and not share them with any third party.

- Accept full responsibility for all activity that occurs under your account, whether authorized by you or not.
4. Google Sign-In & Third-Party Authentication
You may create or link your Curbfind account using your Google account via OAuth 2.0. By doing so, you acknowledge and agree that:
- We receive limited profile data from Google (your email address and display name) solely to create and manage your account. We do not receive your Google password.
- Your Curbfind account email must match your Google account email when linking an existing account.
- Your use of Google Sign-In is governed by Google's Terms of Service and Privacy Policy. We are not responsible for Google's data collection or processing practices.
5. Location Data
Certain features — such as displaying items near you and posting an item on the map — require access to your device's location. Precise geolocation is considered sensitive personal information under applicable law (including COPPA 2026 amendments and CCPA/CPRA). By granting location permission, you understand and agree that:
- Your location is processed locally on your device to search for nearby items. It is transmitted to our servers only at the moment you post an item, to store the item's fixed coordinates on the map.
- We do not continuously track, log, or sell your location. Once an item is posted, only its fixed map coordinates are stored — not your ongoing whereabouts.
- You may deny or revoke location access at any time in your browser or device settings. Some features will be unavailable without it. We will never require location access beyond what is strictly necessary for these core functions.
6. Data & Privacy
Your privacy is a priority. We collect and process only what is necessary to operate the Platform. For Canadian users, we comply with PIPEDA. For California residents, we comply with CCPA/CPRA. Our full Privacy Policy is available in the Help Center.
- We store only your email address, username, avatar, and account metadata (creation date, last login). Your email is private and never displayed publicly on the Platform.
- We do not sell, rent, trade, or share your personal information with third parties for their own marketing purposes.
- We use cookies and browser local storage to manage your session and remember preferences (e.g., language, distance unit). Third-party services such as Google Analytics and advertising partners may also set cookies subject to their own privacy policies.
- You have the right to request access to, correction of, or deletion of your personal data at any time. You may delete your account and all associated data directly from your Settings page, or by contacting us at [email protected].
7. User-Generated Content & Public Posts
Curbfind allows users to post items, photos, descriptions, and other content ("User Content"). By submitting User Content, you agree that:
- You grant Curbfind a non-exclusive, royalty-free, worldwide, sublicensable license to host, store, display, reproduce, and distribute your User Content solely to operate and promote the Platform.
- You represent and warrant that you own or have all necessary rights to post the content, and that it does not infringe any third-party rights including copyright, trademark, or privacy rights.
- Curbfind reserves the right to remove or modify any User Content — including usernames, item names, descriptions, and photos — at its sole discretion, at any time and without notice. This includes content that violates these Terms, our community guidelines, applicable law, or that Curbfind otherwise deems offensive, inappropriate, or harmful to the community.
- You are solely responsible for any content you post. Curbfind is not a publisher and is not liable for any User Content posted by you or any other user.
8. Public Profile & Information Visibility
By creating an account and using the Platform, you understand how your information appears to others:
- Your username and avatar (profile picture) are public and visible to all users and unauthenticated visitors. Choose a username that you are comfortable sharing publicly.
- Items you post on the map — including photos, titles, descriptions, and approximate post location — are publicly visible to all users.
- Your email address is strictly private and is never displayed on the Platform. No other personal data beyond your username and avatar is shared publicly.
9. Free Items Only & Platform Role
Curbfind is exclusively a platform for the free sharing of items. By using the Platform, you agree that:
- All items listed on the Platform must be offered completely free of charge. Listing items for sale, payment, trade, or barter of any kind is strictly prohibited and may result in immediate account termination.
- Curbfind acts solely as a neutral intermediary connecting people who wish to give away items with people who wish to receive them. We are not a party to any transaction or exchange between users, and we make no representations regarding the quality, safety, legality, or condition of any item listed.
- We are not responsible for any disputes, damages, injuries, or losses arising from items exchanged through the Platform. Users interact and transact entirely at their own risk.
10. Real-World Safety Disclaimer
Picking up items may involve real-world interactions and visits to locations listed by other users. Curbfind does not verify the accuracy of listed locations, conduct background checks on users, or monitor item conditions. You acknowledge and accept that:
- Items listed on the Platform are left in public spaces and are available on an "as-is" basis. We make no warranty about their safety, condition, or fitness for any purpose. Inspect items carefully before picking them up.
- We strongly recommend exercising personal caution, visiting pickup locations during daylight hours, and bringing a companion if you are unsure about a location.
- Curbfind is not liable for any injury, property damage, theft, or loss arising from your use of the Platform or your interactions with items or other users.
11. Prohibited Conduct
You agree not to use the Platform to:
- List items that are illegal, stolen, hazardous, dangerous, or completely unusable (e.g., biohazardous waste, firearms, controlled substances, recalled products).
- Sell, trade, or request payment for items in any form. All listings must be completely free.
- Harass, threaten, stalk, defame, or abuse any other user.
- Post false, misleading, or fraudulent content, or impersonate any person or entity.
- Use bots, scrapers, crawlers, or any automated tools to access or collect data from the Platform without prior written consent.
- Attempt to interfere with, circumvent, or gain unauthorized access to the Platform, its servers, or any connected systems.
- Upload content containing malware, viruses, spyware, ransomware, or any other harmful or disruptive code.
- Post offensive, obscene, sexually explicit (NSFW), hateful, discriminatory, or otherwise inappropriate content — including in usernames, item names, descriptions, or photos — as determined at Curbfind's sole discretion.
12. Copyright & DMCA Takedown Policy
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA) and applicable Canadian copyright law. If you believe that content on the Platform infringes your copyright, you may submit a takedown notice to us at [email protected]. Your notice must include: your contact information; identification of the copyrighted work; identification of the infringing content and its location; a statement of good faith belief; and your electronic or physical signature. Additionally:
- We will investigate valid notices and remove or disable access to infringing content where appropriate.
- We maintain a repeat infringer policy. Users who repeatedly post infringing content will have their accounts terminated.
- Filing a false or bad-faith DMCA notice may expose you to liability under applicable law.
13. Third-Party Services & Advertising
The Platform integrates third-party services to operate and sustain itself. By using the Platform, you acknowledge that:
- We use third-party analytics tools (Google Analytics and Sentry) to understand usage patterns and track errors. These tools may collect anonymized data. You can manage your consent for analytics cookies via our Cookie Preferences.
- We display third-party advertisements (via Google AdSense) to support the free operation of the Platform. Advertisers may use cookies to show personalized ads. You can manage your consent for advertising cookies via our Cookie Preferences.
- The Platform may contain links to third-party websites. We are not responsible for the content, privacy practices, or accuracy of those sites. Visiting them is entirely at your own risk.
14. AI-Powered Features
Curbfind uses Cloudflare Workers AI to help identify items from photos you take or upload. Your photos are temporarily processed by Cloudflare's secure AI network to generate item names. The AI suggestions are provided as a convenience only and may not always be accurate. You remain solely responsible for the accuracy of item information you post, regardless of any AI suggestion.
15. Intellectual Property
All Platform content, branding, design, logos, trademarks, and software (excluding User Content) are the exclusive property of Curbfind or its licensors and are protected by Canadian and U.S. intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any part of our proprietary content without our express written permission.
16. Indemnification
You agree to defend, indemnify, and hold harmless Curbfind and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your access to or use of the Platform; (b) your User Content; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) any harm caused to another person or property in connection with your use of the Platform or pickup of any item. This indemnification obligation survives termination of these Terms.
17. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES. ALL ITEMS LISTED ON THE PLATFORM ARE USER-SUBMITTED AND WE MAKE NO REPRESENTATIONS ABOUT THEIR CONDITION, SAFETY, OR LEGALITY. YOUR USE OF THE PLATFORM IS ENTIRELY AT YOUR OWN RISK.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CURBFIND AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, ANY USER CONTENT, OR ANY ITEMS OBTAINED THROUGH THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT LIABILITY CANNOT BE FULLY EXCLUDED UNDER APPLICABLE LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF CAD $50 OR THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
19. Dispute Resolution & Governing Law
We encourage you to contact us first at [email protected] to resolve any dispute informally. If a dispute cannot be resolved informally:
- Governing Law: These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law principles. For users in the United States, applicable U.S. federal law may also apply.
- Jurisdiction: Any legal proceedings shall be brought exclusively in the courts of Quebec, Canada. By using the Platform, you consent to personal jurisdiction in those courts and waive any objection to venue.
- Class Action Waiver: TO THE EXTENT PERMITTED BY LAW, ALL DISPUTES MUST BE BROUGHT INDIVIDUALLY. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS, CLASS-WIDE ARBITRATION, OR REPRESENTATIVE ACTIONS AGAINST CURBFIND.
20. Termination
We reserve the right to suspend or permanently terminate your account and access to the Platform at our sole discretion, with or without notice, if we believe you have violated these Terms, our community standards, or applicable law. Upon termination, your right to use the Platform immediately ceases. All User Content you have posted may be retained or removed at our discretion. Sections 7, 10, 15, 16, 17, 18, and 19 of these Terms survive termination and remain in full effect.
21. Changes to These Terms
We may update these Terms at any time. For material changes, we will notify you by updating the effective date at the top of this page and, where reasonably practical, by in-app notification or email. Your continued use of the Platform after the effective date of any update constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform.
22. General Provisions
If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect (Severability). Our failure to enforce any right under these Terms does not constitute a waiver of that right. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Curbfind regarding use of the Platform and supersede all prior agreements.

This Privacy Policy explains what information we collect, how we use it, who we share it with, and your rights regarding your personal data. 1. Information We Collect
We collect only the information that is necessary to operate the Curbfind platform. This includes:
- Account information: Your username, email address, and encrypted password. If you sign in via Google, we receive your name and email from Google — we never receive your Google password.
- Profile information: An optional avatar (profile picture) that you may upload or select.
- Posted content: Photos you upload, item titles, and descriptions you attach to posts. The approximate location (latitude/longitude) of posted items is stored to display them on the map.
- Device location: Accessed only when you actively post an item or use map features, and only with your explicit permission. Your real-time location is processed locally on your device — we do not continuously track or store your whereabouts.
- Automatically collected data: Standard server logs including your IP address, browser type, operating system, referring URL, and pages visited. This data is used for security monitoring and platform diagnostics.
- Cookies and local storage: Session cookies to keep you logged in, and preference data (language, distance unit) stored locally in your browser.
2. How We Use Your Information
We use the information we collect solely for the following purposes:
- To create, manage, and authenticate your account.
- To display your posts (photos, item name, and fixed location coordinates) to other users on the platform.
- To show you items posted near your location when you use map and search features.
- To send you transactional emails such as account verification, password reset, and important service updates.
- To maintain platform security, prevent abuse and spam, and enforce our Terms of Use.
- To improve the platform through anonymized, aggregated analytics.
3. What Is Publicly Visible
Curbfind is a community platform. The following information is visible to all users and unauthenticated visitors:
- Your username and avatar (profile picture).
- Posts you create: the photo(s), item title, description, and the fixed location of the item on the map.
Note: Your email address, your real-time location, your account creation date, and any other account details are strictly private and are never displayed publicly. The location stored with your posts is the location of the item — not a reflection of your home address or ongoing whereabouts.
4. Location Data — Special Notice
Precise geolocation is considered sensitive personal information under applicable law (including the COPPA 2026 amendments, CCPA/CPRA, and Canada's PIPEDA). We treat it accordingly:
- We only access your device location when you explicitly grant permission and actively use a location-dependent feature (posting an item, viewing nearby items on the map).
- Your location is never tracked continuously, stored in real time, or associated with your account history.
- When you post an item, only the fixed coordinates of that item's location are stored. These coordinates represent the item's position — not your personal location profile.
- Your location data is never sold, rented, or shared with advertising networks or data brokers.
- You may revoke location access at any time via your browser or device settings. Revoking access will disable location-dependent features, but your account will remain fully functional.
5. Photos and User-Generated Content
When you upload a photo to Curbfind:
- Your photo is temporarily processed through Cloudflare Workers AI to suggest item names, and then uploaded to our servers and stored to be displayed with your post.
- Photos you upload are publicly visible as part of your posts. Do not include personal, sensitive, or identifiable information in your photos (such as faces, license plates, or personal documents).
- We strip EXIF metadata (including any GPS coordinates embedded in image files) from uploaded photos. The item's location is obtained separately from your device's geolocation API, not from photo metadata.
- You retain ownership of your photos. By uploading, you grant us a limited license to host and display them on the platform, as described in our Terms of Use. You may delete your posts — and the associated photos — at any time from your account settings.
6. Cookies and Tracking Technologies
We use the following types of cookies and storage mechanisms:
- Essential cookies: Required for login sessions and security. These cannot be disabled without breaking core platform functionality.
- Preference cookies: Store your language and distance unit settings. These can be cleared via your browser settings.
- Third-party cookies: Our analytics providers (Google Analytics, Sentry) and advertising partners (Google AdSense) may set cookies subject to their own privacy policies. You can manage your consent for these optional cookies at any time using the Cookie Preferences link in the footer.
- Security tools: We use Cloudflare Turnstile for bot protection. Cloudflare may process your IP address and browser fingerprint to assess whether a request is human. Cloudflare's privacy policy applies to this processing.
7. How We Share Your Information
We do not sell, rent, or trade your personal information. We share your data only in the following limited circumstances:
- Service providers: Trusted third-party vendors who help us operate the platform (e.g., cloud hosting, email delivery via Resend, image storage). These providers are contractually bound to process data only on our behalf and in accordance with our instructions.
- Legal requirements: If required by law, court order, or lawful government request, we may disclose information to comply with our legal obligations. We will notify you of such requests where legally permitted.
- Business transfer: In the event of a merger, acquisition, or sale of assets, your data may be transferred to the successor entity. We will notify you in advance and your rights will be preserved.
- Protection of rights: We may disclose information to protect the safety of our users, enforce our Terms of Use, or prevent fraud and abuse.
8. Data Retention
We retain your personal data only for as long as necessary:
- Account data (username, email, hashed password) is retained for as long as your account is active. You may delete your account at any time from your Settings page, which will permanently erase your account data and all associated posts.
- Posts and associated images are retained until deleted by you or removed by our moderation team.
- Server log data (IP addresses, access logs) is retained for up to 90 days for security purposes and then permanently deleted.
- Anonymized and aggregated data (e.g., usage statistics) may be retained indefinitely as it cannot be linked back to any individual.
9. Children's Privacy
Curbfind is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13, in compliance with the Children's Online Privacy Protection Act (COPPA) and applicable Canadian law. If we become aware that a child under 13 has created an account, we will promptly delete their account and all associated data. 10. Your Privacy Rights
Depending on your jurisdiction (including under the GDPR, CCPA/CPRA, and PIPEDA), you may have the following rights regarding your personal data. We honour these rights for all users regardless of location:
- Right to Access: Request a copy of the personal data we hold about you.
- Right to Correction: Request that we correct inaccurate or incomplete information.
- Right to Deletion: Request that we delete your personal data. You can do this directly from your Settings page or by contacting us.
- Right to Withdraw Consent: Withdraw consent for any processing based on consent (e.g., location access) at any time. Withdrawal does not affect the lawfulness of prior processing.
- Right to Data Portability: Request a structured, machine-readable copy of your data.
- Right to Object / Opt-Out of Sale: We do not sell your data. You may opt out of any future targeted advertising at any time through your browser's cookie settings or by contacting us.

11. Security
We implement industry-standard security measures to protect your personal information, including HTTPS encryption for all data in transit, hashed and salted password storage, access controls limiting staff access to personal data, and regular security reviews. 12. Third-Party Services
Our platform integrates with the following third-party services, each governed by their own privacy policies:
- Google Sign-In (OAuth 2.0): Used for optional account authentication. Google's Privacy Policy applies.
- Cloudflare Turnstile: Used for bot protection on forms. Cloudflare's Privacy Policy applies.
- Advertising partners: Third-party ad networks may display ads on the platform and set cookies. You can control ad tracking through your browser settings or by using an ad blocker.
- Cloud infrastructure: Our platform is hosted on cloud infrastructure providers. Data is stored within servers subject to appropriate data processing agreements.
13. International Data Transfers
Curbfind is operated from Canada. If you access the platform from the EEA or outside Canada, your information may be transferred to and processed in Canada or the US. We rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses (SCCs) or adequacy decisions, to ensure your data is protected when transferred internationally.
14. Do Not Track
Some browsers include a "Do Not Track" (DNT) feature that sends a signal to websites requesting that your browsing not be tracked. We honor DNT signals to the extent technically feasible. We do not cross-site track users for advertising purposes and we do not sell your personal data to third parties.
